1. Agreement
The Proxigem app and site are developed and operated by Proxigem ("we", "us"), reachable at privacy@proxigem.com. By using the Proxigem app or the proxigem.com API you agree to these terms and to the Privacy Policy. If you do not agree, don't use the service. Features that send anything to our servers (such as submitting a place rating) additionally ask for your explicit agreement in the app before first use.
2. The service
Proxigem shows notable places around a location, working primarily offline from a bundled database with optional online features (data updates, regional pack downloads, fresher place details, and community ratings). The service is provided free of charge and may change, be interrupted, or be discontinued at any time.
3. Place content, accuracy & safety
- Place descriptions derive from community and open-data sources (Wikipedia, Wikidata, GeoNames and others) and are provided as-is. They may be incomplete, out of date, or wrong — including a place's position, name, and description.
- Proxigem is not a navigation tool and its content is not professional advice. Always use your own judgement: obey signage, respect private property, and take care near roads, water, cliffs and other hazards. A place appearing in Proxigem does not mean it is safe — or lawful — to visit.
- Some entries describe historical events, including crimes and tragedies, in a factual, documentary style. They are included for their historical and educational interest. Locations connected to such events may be ordinary private property today; do not disturb occupants.
4. Content licences & attribution
- Place text sourced from Wikipedia/Wikidata is licensed under CC BY-SA 4.0; each entry carries its source and licence line. If you reuse content from Proxigem, you must preserve that attribution and licence.
- Map imagery is © OpenStreetMap contributors; place photos load from Wikimedia Commons under their respective licences.
- The Proxigem name, wordmark and app design are ours; these terms grant no rights to them.
5. Community ratings
Signed-out, anonymous star ratings are Proxigem's only user-contributed content. When you rate a place:
- Your rating is combined into a public aggregate (average and count) shown to all users of the app. Individual ratings are never shown, and nothing identifies you (see the Privacy Policy on the anonymous installation identifier).
- You agree to rate honestly, based on your own experience or knowledge of the place.
- You must not manipulate ratings: no automated submissions, no coordinated or incentivised voting, no attempts to inflate or damage a place's rating. We enforce technical limits (rate caps per client) and may discard ratings we judge to be manipulation.
- We may remove or reset ratings, or block clients, at our discretion to protect the integrity of the feature.
- To report suspected rating abuse — or anything else that looks wrong — email privacy@proxigem.com; you can also ask us to delete the ratings tied to your installation identifier.
6. Acceptable use of the API
- The proxigem.com API exists to serve the Proxigem apps. Don't flood it, probe it, or attempt to disrupt it; automated access outside the app is not permitted without our written agreement.
- Don't attempt to bypass rate limits, forge identifiers, or submit data on behalf of installations that aren't yours.
7. Disclaimer & liability
To the maximum extent permitted by law, the service is provided without warranties of any kind, and we are not liable for loss or damage arising from its use — including reliance on place data or travel to any location. Nothing in these terms excludes rights that cannot be excluded under applicable law (for Australian users, the Australian Consumer Law guarantees apply to the extent required).
8. Changes & termination
We may update these terms; the effective date above will change and material updates will be noted in the app's release notes. Continuing to use online features after a change means you accept the updated terms — the app will re-ask for rating consent if the rating terms change materially. We may suspend access (e.g. block abusive clients) to protect the service.
9. Governing law
These terms are governed by the laws of Victoria, Australia, and disputes are subject to the non-exclusive jurisdiction of its courts.
